Florida Mortgage Taxes at Closing: Doc Stamps and Intangible Tax by Loan Amount
Two state taxes add up to 0.55% of a Florida purchase loan: documentary stamp tax at 0.35% and the intangible tax at 0.2%. Here is the table by loan amount, the statutes behind it, and what it does not include.
Florida charges two state taxes on a purchase mortgage: documentary stamp tax at 0.35% of the loan and a one-time intangible tax at 0.2%, for 0.55% together. On a $400,000 loan that is $2,200. A cash purchase pays neither.
The two taxes
Documentary stamp tax on the mortgage. The statute sets the tax at 35 cents on each $100 of indebtedness, or fraction of $100. When there is both a mortgage and a note, the tax is paid on the mortgage at recording and the note is notated that it was paid (Fla. Stat. 201.08, paragraphs (1)(a) and (1)(b)).
Intangible tax. A one-time tax of 2 mills, or 0.2%, on each dollar of the obligation, to the extent it is secured by a lien on Florida real property (Fla. Stat. 199.133).
What they cost by loan amount
The table applies the two rates above to the loan amount. It is arithmetic on the statutes, not a quote.
| Loan amount | Doc stamps (0.35%) | Intangible tax (0.2%) | Total |
|---|---|---|---|
| $200,000 | $700 | $400 | $1,100 |
| $300,000 | $1,050 | $600 | $1,650 |
| $400,000 | $1,400 | $800 | $2,200 |
| $500,000 | $1,750 | $1,000 | $2,750 |
| $600,000 | $2,100 | $1,200 | $3,300 |
| $800,000 | $2,800 | $1,600 | $4,400 |
| $1,000,000 | $3,500 | $2,000 | $5,500 |
About the $2,450 cap
You will see a $2,450 cap on Florida doc stamps. In the statute that cap is written into paragraph (1)(a), which covers promissory notes and similar written obligations. Paragraph (1)(b), which covers mortgages, states no cap in the text. The table above therefore does not apply one. Which paragraph a particular loan falls under is a question for the closing agent, so compare the table with the figure on your Loan Estimate and Closing Disclosure rather than relying on either.
What this does not include
These are the lender-side taxes, charged on the loan. The 0.70% documentary stamp on the deed is a different tax, based on the sale price, and in most Central Florida contracts the seller pays it; see Florida seller closing costs. Lender fees, title insurance, prepaid items and escrows are separate lines too. For the full buyer picture, read Florida buyer closing costs, and run a purchase through the buyer net sheet to see your cash to close. If you are weighing a price against a loan size, the affordability calculator shows the payment.

Frequently asked questions
- How much are doc stamps on a mortgage in Florida?
- The statute sets the tax at 35 cents on each $100 or fraction thereof of the indebtedness. On a $400,000 loan that is $1,400. When there is both a mortgage and a note, the tax is paid on the mortgage at recording and the note is notated (Fla. Stat. 201.08(1)(b), read October 29, 2026).
- What is the Florida intangible tax on a mortgage?
- It is a one-time tax of 2 mills, or 0.2%, on each dollar of the obligation, to the extent it is secured by a lien on Florida real property (Fla. Stat. 199.133, read October 29, 2026). On a $400,000 loan that is $800.
- Is there a cap on Florida mortgage doc stamps?
- The $2,450 cap appears in paragraph (1)(a) of Fla. Stat. 201.08, which covers promissory notes and similar written obligations. The text of paragraph (1)(b), which covers mortgages, contains no cap. Which paragraph applies to a given loan is a question for your closing agent, so check the figure on your Loan Estimate and Closing Disclosure.
- Do cash buyers pay doc stamps and intangible tax?
- Both taxes are imposed on the loan secured by the mortgage, so a purchase with no mortgage has neither. The deed doc stamp, which is based on the sale price, is separate and is paid whether or not there is a loan.
